Council Minutes - February 1st, 2005
The meeting of February 1st, 2005 was called to order by with the Pledge of Allegiance by Mayor Bickley.

Roll Call: Present - Bagnato, Dickman, Fox, Jenkins, Kovesdi and Wolf.

Motion by Dickman, seconded by Fox to approve the Minutes of January 18th, 2005. Vote-all yeas, motion carried.

Motion by Fox, seconded by Kovesdi to pay the Council Bills for February 1st, 2005 in the amount of $31,,034.41. Vote-all yeas, motion carried.

Motion by Dickman, seconded by Fox to pay the Utility Bills for February 1st, 2005 in the amount of $65,874.46. Vote-all yeas, motion carried.


CITIZEN PARTICIPATION

Jonathan Danda of 81 Elm Street questioned Council on his electric bill, wondering why the PPC was so high. Council will look into this matter and get back to him.

OLD COMMITTEE BUSINESS

Streets, Sidewalks and Storm Sewers-None

Safety-Motion by Jenkins, seconded by Dickman to include all part-time police in the 3%, effective immediately. Vote-all yeas, motion carried.

Finance-None

Regional Planning, Building Codes & Inspection - None

NEW COMMITTEE BUSINESS

Streets, Sidewalks, and Storm Sewers -Lawrence Smith will prioritize his equipment needs and get back to the street committee with it.

The street department will look into the problems with Chippewa Street.

Mr. Stevens of Milan Manor has concerns about a pipe that is perforated and flooding. Mr. Stevens installed the pipe, but it is on the Village right-of-way.

There were questions about the no parking ordinance 363-14-04. It may have been a mis-interpitation with the police chief, but will be looked into.

Motion by Fox, seconded by Jenkins to authorize the Mayor to sign the ordinance from ODOT pertaining to the resurfacing of St. Rt. 113/ 61 overlap. There is no title for the ordinance as ODOT uses a standard legislation. Roll call: Dickman-yes, Fox-yes, Jenkins-yes, Kovesdi-yes, Wolf-yes, Bagnato-yes. Motion carried, ordinance no. 373-02-05

Finance- A RESOLUTION WITHHOLDING CONSENT FOR THE REMISSION OF TAXES, PENALTIES AND INTEREST ON AN APPLICATION FOR REAL PROPERTY TAX EXEMPTION FILED UNDER SECTION 3 OF SUB. H.B. 362 OF THE 125TH GENERAL ASSEMBLY. Motion by Bagnato, seconded by Fox to adopt by title only. Roll call: Fox-yes, Jenkins-yes, Kovesdi-yes, Wolf-yes, Bagnato-yes, Dickman-yes. Motion carried, resolution no. 524-02-05

Motion by Kovesdi, seconded by Bagnato to award Julie Stelzer a new hourly rate of $9.00 an hour, which incorporates her probationary rate and cost of living increase. Vote-all yeas, motion carried.

Regional Planning, Building Codes & Inspection -None

Utilities-None

Civic Contact and Historical Preservation-Motion by Bagnato, seconded by Fox to allow the Edison High School Music Department to run the village parking lot during the weekend of the Melon Festival. Vote-all yeas, motion carried.

A letter from Key Bank in Milan was read thanking Jim Ward for plowing the parking lot allowing the ATM to be used.

Parks and Trees-None

UNFINISHED BUSINESS

Motion by Jenkins, seconded by Fox to have no further action on the computer software. Vote-all yeas, motion carried.

John Batchelor, Joe Barone and William Mattledge will remain on the Planning Commission until 2008, with Lois Wolf as the appointed Council representative. . Stan Roberts, Ed Zacherl, Dan Frederick and Bob Gliatta have been re-appointed to the Zoning Board of Appeals until 2008. Dave Jenkins is Council representative on this committee. John Fox is the delegate for Erie Regional Planning and Building Codes with Mike Bagnato serving as the alternate. Art Dickman will serve as delegate for Eric County Council of Government, with John Fox as alternate. Motion by Bagnato, seconded by Jenkins to accept these appointments. Vote-all yeas, motion carried.

Questions were raised on street numberings.

Over crowdedness at the new fire station during voting times was discussed.

Legislation

AN ORDINANCE ESTABLISHING ZONING IN NEWLY ANNEXED TERRITORY IN THE VILLAGE OF MILAN, OHIO. Motion by Wolf, seconded by Fox to bring this ordinance to its second reading by title only. Vote-all yeas, motion carried.

It was discussed using the Administration Building for an emergency shelter.

EHOVE may be able to paint the screens for the police that are needed in the basement.

Motion by Jenkins, seconded by Fox to enter into Executive Session to discuss personnel. Roll call: Jenkins-yes, Wolf-yes, Bagnato-yes, Dickman-yes, Fox-yes, motion carried.

Motion by Bagnato, seconded by Fox to return to Regular Session. Roll call: Wolf-yes, Bagnato-yes, Dickman-yes, Fox-yes, Jenkins-yes, motion carried.

Motion by Jenkins, seconded by Bagnato to allow the Village to supply vacation hours for Ward if necessary to take an 80 hour vacation he cannot be refunded on. Vote-all yeas, motion carried.

Motion by Dickman, seconded by Fox to adjourn. Vote-all yeas, motion carried.
