Council Minutes - May 2, 2006
The meeting of May 2nd, 2006 was called to order with the Pledge of Allegiance by Mayor Robert C. Bickley.

Roll Call: present-Bagnato, Dickman, Fox, Jenkins, Maloney and Martin.

Motion by Dickman, seconded by Fox to approve the Minutes of April 18th, 2006. Vote-all yeas, motion carried.

Motion by Fox, seconded by Jenkins to approve the Council Bills for May 2nd , 2006 in the amount of $16,813.46. Vote-all yeas, motion carried.

Motion by Dickman, seconded by Fox to approve the Utility Bills for May 2nd , 2006 in the amount of $29,944.05. Vote-all yeas, motion carried.

CITIZEN PARTICIPATION

Pete Schade and Karen Gerold of the Erie County Health Department were in attendance to speak to Council about selected topics for a presentation on the activities of the Health Department for spring 2006.

Also in attendance were Jim Ward, Marilyn and Diane Ortman.

Streets, Sidewalks and Storm Sewers-None

Safety-None

Finance-None

Regional Planning, Building Codes & Inspection-None

Utilities-A letter was received from Chris Thomas representing Time Warner in response to the Village's suggested changes with the next step to be formal documents. Thomas would like to add a separate pole agreement.

Civic Contact and Historical Preservation -None

Parks and Trees-None

NEW COMMITTEE BUSINESS

Streets, Sidewalks, and Storm Sewers -A recent article in the newspaper stated sidewalks with 2foot tree lawns are part of the current design on the Swan Street plans. The only side walk will be on the south side of Swan Street where there is currently a sidewalk.

Safety-Motion by Dickman, seconded by Fox to appoint Bryan Rohrbacher as a non-paid reserve officer until trained, and then hire him in at $8.75 and hour with a one-year probationary period. Vote-all yeas, motion carried.

Finance-Motion by Maloney, seconded by Bagnato to award the Fiscal Officer her 3% raise that was awarded to all other employees in the beginning of the year, on her anniversary date of May 9th . Vote-all yeas, motion carried.

Regional Planning, Building Codes & Inspection-There will be a presentation at Firelands College on Wednesday May 3rd on alternative energy.

Utilities-The small bucket truck needs repairs in the area of $5000.00.

Civic Contact and Historical Preservation-Motion by Martin, seconded by Bagnato to allow the National Day of Prayer the gazebo on May 4, from 6:00 P.M. to 8 P.M., the Erie Health Department the use of Council Chambers for their monthly meeting July 25. Vote-all yeas, motion carried.

The Mayor read Proclamations for Eagle Scouts Nathaniel Uther and Evan Cornell.

Kelly Graphics will have an Open House this Friday, Saturday and Sunday.

UNFINISHED BUSINESS

LEGISLATION

AN ORDINANCE AMENDING SECTION 151.18 OF THE CODIFIED ORDINANCES OF THE VILLAGE OF MILAN, OHIO, PERTAINING TO TRAVEL REIMBURSEMENT POLICY. Motion by Maloney, seconded by Bagnato to bring this ordinance to its first reading by title only. Vote-all yeas, motion carried.

A RESOLUTION AMENDING RESOLUTION NO. 531-02-06 PERTAINING TO CONTRACTS FOR VILLAGE FINANCING OF THE LANDSDOWN ROAD RESIDENTS PREDETERMINED SEWER TAP FEE AND DECL;ARING AN EMERGENCY. Motion by Bagnato to suspend the rules, seconded by Fox to suspend the rules. Roll call : Dickman-yes, Fox-yes, Jenkins-yes, Maloney-yes, Martin-yes, Bagnato-yes, motion carried. Motion by Bagnato, seconded by Fox to adopt by title only. . Roll call : Fox-yes, Jenkins-yes, Maloney-yes, Martin-yes, Bagnato-yes, Dickman. Motion carried, Resolution no. 532-05-06. This resolution was amended to include an end date.

Motion by Dickman, seconded by Fox to enter into Executive Session to discuss imminent litigation. Roll call: Jenkins-yes, Maloney-yes, Martin-yes, Bagnato-yes, Dickman-yes, Fox-yes, motion carried.

Motion by Fox, seconded by Bagnato to return to regular session. . Roll call: Maloney-yes, Martin-yes, Bagnato-yes, Dickman-yes, Fox-yes, Jenkins-yes, motion carried.

Motion by Fox, seconded by Dickman to take care of insurance for Jim Ward tonight and not let it continue on any longer.

Motion by Fox, seconded by Dickman to give Jim Ward health insurance, no strings attached, no 10%, the same as all other Village employees. Roll call: Martin-no, Bagnato-no, Dickman-yes, Fox-yes, Jenkins-yes, Maloney-no, vote tied, Mayor Bickley votes yes to break the tie. Jim Ward is given Village insurance effective June 1st , 2006.

Motion by Bagnato, seconded by Dickman to cancel the next regularly scheduled Council meeting on May 16th , 2006 and authorize the Fiscal Officer to pay the bills. Vote-all yeas, motion carried.

Motion by Dickman, seconded by Fox to adjourn. Vote-all yeas, motion carried.
