Council Minutes - June 15, 2004

President Pro Temp John Fox called the Council meeting of June 15th, 2004 to order by with the Pledge of Allegiance. Mayor Bickley was attending a conference.

Roll Call: Present - Bagnato, Dickman, Fox, Kovesdi and Wolf. Jenkins absent.

Motion by Wolf seconded by Dickman to approve the Minutes of the June 1st . Vote-all yeas, motion carried.

Motion by Bagnato, seconded by Wolf to pay the Council bills for June 15th , 2004 in the amount of $32,767.16. Vote-all yeas, motion carried.

Motion by Dickman, seconded by Bagnato to pay the Utility bills for June 15th , 2004 in the amount of $48,993.57. Vote-all yeas, motion carried.

CITIZEN PARTICIPATION

Roger Binette who is running for the fourth judge Erie County and Joe Hayberger who is running for Erie County Commissioner introduced themselves to Council.

Civic Contact and Historical Preservation-Wolf gave Council an update of the Moravians Festival over the weekend.

NEW COMMITTEE BUSINESS

Streets, Sidewalks, and Storm Sewers - Motion by Bagnato, seconded by Kovesdi to authorize the Solicitor to prepare the legislation for the Oak/Huron Streets project for a price of $171,171.00. Vote-all yeas, motion carried.

Motion by Bagnato, seconded by Dickman to dig a swail and return the Deehr property to its prior condition before the Milan Manor job. Council feels this is the only way to deal with the drainage problem., although Mayor Bickley disagrees.

The Village would like to purchase their own striper for an amount around $5000.00.

Safety-Motion by Dickman, seconded by Bagnato to hire Joshua Bryant as a part-time officer effective immediately with a starting wage of $8.50 an hour, with a one-year probationary period. Vote-all yeas, motion carried.

It was suggested re-visiting the scooter law, since the electric scooters are becoming more popular.

Finance-Motion by Bagnato, seconded by Kovesdi to authorize the Fiscal Officer to pay the bills before she leaves on vacation, since she will not be at the July 6th meeting. Vote-all yeas, motion carried.

The Fiscal Officer will be doing payroll on June 25, 2004 since she will be on vacation most of the following week, when payroll would usually be done.

Motion by Wolf, seconded by Kovesdi to rescind the motion at the June 1st meeting to pay off the sewer note. The Finance Committee and Fiscal Officer have chosen to go with a 5 year bond, with the option of paying it off early. Roll call: Dickman-yes, Fox-yes, Kovesdi-yes, Wolf-yes, Bagnato, motion carried.

The Fiscal Officer read the Fiscal Officer's Certificate followed by AN ORDINANCE PROVIDING FOR TH ISSUANCE AND SALE OF BONDS IN THE PRINCIPAL AMOUNT OF $170.000.00 FOR THE PURPOSE OF PAYING A PORTION OF THE COSTS OF IMPROVING THE VILLAGE'S SANITARY SEWERAGE SYSTEM BY CONSTRUCTING A NEW WASTEWATER TREATMENT PLANT, SEWER LINES AND RELATED IMPROVEMENTS AND ACQUIRING REAL ESTATE AND EQUIPMENT IN CONNECTION THEREWITH, TOGETHER WITH ALL NECESSARY APPURTENANCES, AND DECLARING AN EMERGENCY. Motion by Dickman, seconded by Wolf to suspend the rules. Roll call: Fox-yes, Kovesdi-yes, Wolf-yes, Bagnato-yes, Dickman-yes, motion carried. Motion by Bagnato, seconded by Kovesdi to adopt by title only as an emergency. Roll call: Wolf-yes, Bagnato-yes, Dickman-yes, Fox-yes, Kovesdi-yes. Motion carried. , Ordinance no. 351-06-04

Regional Planning, Building Codes & Inspection -The swimming pool ordinance will be revisited. Currently, only in ground pools require fencing in.

Hinckley-Lutes finished the work on Elm Street.

Utilities-None

Civic Contact and Historical Preservation-Lynn Ramsier has agreed to split the $600.00 cost of replacing the shrubs on Center Street that were pulled to fix Wilcoxson Street.

Parks and Trees-Three trees need to be taken down due to their conditions.

Legislation

A RESOLUTION CONSENTING TO THE PROPOSED LANDSDOWN LAND COMPANY LLC ANNEXATION TO THE VILLAGE OF MILAN AND ACCEPTANCE THE MAINTENANCE OF LANDSDOWN ROAD AND DECLARING AN EMERGENCY. Motion by Wolf, seconded by Dickman to suspend the rules. Roll call: Wolf-yes, Bagnato-abstain, Dickman-yes, Fox-yes Kovesdi-yes, motion carried. Motion by Dickman, seconded by Kovesdi to adopt as an emergency by title only. Roll call: Bagnato-abstain, Dickman-yes, Fox-yes, Kovesdi-yes, Wolf-yes. Motion carried, Ordinance no. 519-06-04

A RESOLUTION STATING THE MUNICIPAL SERVICES TO BE PROVIDED IN THE EVENT THE LANDSDOWN LAND LLC COMPANY ANNEXATION IS APPROVED AND THE PROPOSED TERRITORY IS ANNEXED TO THE VILLAGE OF MILAN AND DECLARING AN EMERGENCY. Motion by Dickman, seconded by Kovesdi to suspend the rules. Roll call: Dickman-yes, Fox-yes, Kovesdi-yes, Wolf-yes, Bagnato-abstain, motion carried. Motion by Wolf, seconded by Dickman to adopt as an emergency by title only. Roll call: Fox-yes, Kovesdi-yes, Wolf-yes, Bagnato-abstain, Dickman-yes. Motion carried, Ordinance no. 520-06-04

An abstention goes with the majority of votes.

The township Landsdown is currently zoned R1, but Landsdown Land LLC Company would like it to be zoned like the Village as an R1.

Motion by Bagnato, seconded by Kovesdi to enter into Executive Session to discuss imminent litigation. Roll call: Kovesdi-yes, Wolf-yes, Bagnato-yes, Dickman-yes, Fox-yes, motion carried.
