Council Minutes - July 5th, 2005
The meeting of July 5th, 2005 was called to order with the Pledge of Allegiance by Mayor Robert C. Bickley.

Roll Call: Present -Bagnato, Dickman, Fox, Jenkins, Kovesdi and Wolf.

Motion by Wolf, seconded by Fox to approve the Minutes of June 21st, 2005. Vote-all yeas, motion carried.

Motion by Fox, seconded by Jenkins to approve the Council bills for July 5th, 2005 in the amount of $19,097.95. Vote-all yeas, motion carried.

Motion by Kovesdi, seconded by Fox to approve the Utility bills for July 5th, 2005 in the amount of $93,538.28. Vote-all yeas, motion carried.

CITIZEN PARTICIPATION

Tim Morsher of The Coffee Station informed Council the Cruisin On The Square on Tuesday nights was going well. Motion by Wolf, seconded by Bagnato to allow Cruisin On The Square signs in the square with no business logo on it. Vote-all yeas, motion carried.

Richard Maloney had questions about the electric purchase power cost adjustment and questioned whether it was due to the combustion turbine project. The Administrator explained it was due to the seamless elimination cost adjustment charges and the adder would most likely remain at current level for the next several months.

Regional Planning, Building Codes & Inspection-The Village has maps of the downtown area, courtesy of Dan Frederick.

There was a proposal Wolf, Bagnato and Lawrence Smith make a recommendation to Council a modification of the fence ordinance.

Council would like Building Inspector John Zimmerman to explain the swimming pool regulations.

Alex MacNichol will be invited to the next meeting to discuss the paving and ideas behind the restaurants. The Village is interested in matching funds.

Utilities-None

Civic Contact and Historical Preservation-A new show will be televised soon, granting three wishes and Milan could be one of the locations.

Growers Chemical is celebrating 50 years.

Parks and Trees-None

NEW COMMITTEE BUSINESS

Streets, Sidewalks, and Storm Sewers -None

Safety-Motion by Dickman, seconded by Jenkins to hire part-time officer David Johnson effective July 5th, 2005 at a starting rate of $8.75 an hour with one-year probation. Vote-all yeas, motion carried.

Finance-Motion by Bagnato, seconded by Fox to authorize the Fiscal Officer to reprint the Erie County Landfill check in the correct amount of $953.89. Vote-all yeas, motion carried.

Motion by Wolf, seconded by Kovesdi to authorize the Fiscal Officer to pay Council bills on the July 21st, as she will be on vacation during the next Council meeting. Vote-all yeas, motion carried.

Motion by Jenkins, seconded by Fox to authorize the Fiscal Officer to forward the annual budget to the Erie County Auditor as it was reviewed and recommended by Council at the Public Hearing earlier tonight. Vote-all yeas, motion carried.

Regional Planning, Building Codes & Inspection -Motion by Wolf, seconded by Bagnato to schedule a Public Hearing on August 16th , 2005 at 6:45 P.M. to discuss the proposed changes to the Zoning Code. Vote-all yeas, motion carried.

Utilities-Shut off fees will be permanently printed on utility bills the next time they are ordered.

Civic Contact and Historical Preservation-Motion by Bagnato, seconded by Jenkins to appoint Jim Brown to the Weapons of Mass Destruction (WMD) Advisory Board in July 2005. The Board will meet quarterly, once a month. Bickley will serve as alternate. Vote-all yeas, motion carried.

LEGISLATION

AN ORDINANCE SETTING THE TAP FEE FOR PROPERTIES ACESSING THE GRAVITY SEWER TO BE CONSTRUCTED ALONG LANDSDOWN STREET IN THE VILLAGE OF MILAN, OHIO. Motion by Bagnato, seconded by Fox to bring this ordinance to its second reading by title only. Vote-all yeas, motion carried.

AN ORDINANCE DISIGNATING THURSDAY AS GARBAGE PICKUP DAY WITHIN THE VILLAGE OF MILAN. Motion by Bagnato, seconded by Jenkins to bring this ordinance to its second reading by title only. Council intends to leave this reading on second reading while looking into it further. Vote-all yeas, motion carried.

AN ORDINANCE TO AUTHORIZE THE EXECUTION OF A MASTER SERVICES AGREEMENT BETWEEN THE VILLAGE OF MILAN AND AMERICAN MUNICIPAL POWER-OHIO, INC. Motion by Bagnato, seconded by Fox to bring this ordinance to its third and final reading by title only. Vote-all yeas, motion carried. Motion by Bagnato, seconded by Dickman to adopt. Roll call: Dickman-yes, Fox-yes, Jenkins-yes, Kovesdi-yes, Wolf-yes, Bagnato-yes. Motion carried, Ordinance no. 384-07-05

AN ORDINANCE AUTHORIZING THE EXECUTION OF THE COMBUSTION TURBINE POWER SCHEDULE BETWEEN THE VILLAGE OF MILAN AND AMERICAN MUNICIPAL POWER-OHIO, INC. Motion by Bagnato, seconded by Fox to bring this ordinance to its third and final reading by title only. Vote-all yeas, motion carried. Motion by Bagnato, seconded by Kovesdi to adopt. Roll call: Fox-yes, Jenkins-yes, Kovesdi-yes, Wolf-yes, Bagnato-yes, Dickman-yes. Motion carried, Ordinance no. 385-07-05


AN ORDINANCE AUTHORIZING THE EXECUTION OF POWER PURCHASE SCHEDULES TO SELL THE MUNICIPALITY'S PROJECT SHARE OF THE CAPACITY OF COMBUSTION TURBINE PROJECT TO AMERICAN POWER-OHIO, INC. Motion by Bagnato, seconded by Fox to bring this ordinance to its third and final reading by title only. Vote-all yeas, motion carried. Motion by Bagnato, seconded by Dickman to adopt. Motion by Fox, seconded by Kovesdi to have letters sent to all trash haulers about specific pick-up days. Vote-all yeas, motion carried.
