Council Minutes - August 2nd, 2005
The meeting of August 2nd, 2005 was called to order with the Pledge of Allegiance by Mayor Robert C. Bickley.

Roll Call: Present -Bagnato, Dickman, Fox, Jenkins, Kovesdi and Wolf.

Motion by Fox, seconded by Bagnato to approve the Minutes of July 21st, 2005. Vote-all yeas, motion carried.

Motion by Bagnato, seconded by Fox to approve the August 2nd, 2005 Council bills in the amount of $31, 592.61. Vote-all yeas, motion carried.

Motion by Dickman, seconded by Fox to approve the August 2nd, 2005 Utility bills in the amount of $12, 400.85. Vote-all yeas, motion carried.

CITIZEN PARTICIPATION

Wayne Roesch approached Council about paving the Village owned alley next to his garage. The matter, after being discussed with the Street Department Superintendent, will be referred to Street Committee, to be reviewed at the next Street Meeting on August 16th, 2005.

OLD COMMITTEE BUSINESS

Streets, Sidewalks and Storm Sewers-The Street Committee will look into engineering the parking lot behind the restaurants on the square. There is a possibility it has already been done.

The Mayor will see if the list for sidewalk repairs has been completed.

Safety-None

Finance-None

Regional Planning, Building Codes & Inspection-It was suggested expanding the historic district from Kelley to Huron to Merry to Edison Drives for the proposed fence ordinance. Returning the height to 6 feet, allowing stockade in rural and chain link fences outside the historical portion were recommended. The changes should be ready for the next Council meeting.

Utilities-None

Civic Contact and Historical Preservation-The Mayor gave a Village tour to The Red Hat Ladies from Oak Harbor.

The Village of Milan is the only Erie County member of TMACOG.

Parks and Trees-None

NEW COMMITTEE BUSINESS

Streets, Sidewalks, and Storm Sewers -None

Safety-Motion by Dickman, seconded by Fox to hire Michael Finn, effective August 2nd , 2005, as a part-time police officer at a rate of $8.75 with a one-year probationary period. Vote-all yeas, motion carried.

Finance-None

Regional Planning, Building Codes & Inspection -Tim King would like to come the next Council meeting to talk about a grant for low income housing.

There are houses on Wilcoxson and Pawnee where the grass is too high, that need to be looked into.

Utilities-The waterline on Bond Street may be done for under $15, 000.00 Bagnato and Dickman will discuss it with Kevin Ackerman.

Civic Contact and Historical Preservation-The Mayor addressed Council on Jim Brown's response to the Mayor's letter dated August 1st, 2005 asking the Administrator to resign. Jim Brown requested in writing that any action taken against him in tonight's meeting be on the record. The Mayor stated Council was concerned about not having the Administrator at Council meetings to represent the Village and concern and reference to the November 16th, 2004 meeting where he had made this a point. . The Mayor put it on the table for discussion . The Solicitor said " following the Ohio Revised Code, are you removing the village administrator and asking Councils approval. ?" The Mayor stated he requested a letter from Brown and was told by Brown it was up to Council to request a letter from him and the Mayor said he requested it. The Solicitor added since Brown hasn't done that what the Mayor is saying is action has been taken in open session and on the record, and there are two ways to go about it:

1. The Mayor removes the Administrator and asks Council to approve it with a 4 out of 6 votes, or

2. If the Mayor doesn't recommend, Council must approve with a 5 out of 6 vote. The Solicitor then asked the Mayor if he was indicating to Council his recommendation for Brown's removal.

The Mayor stated his was that he was asking for it in writing. Brown wasn't here to receive it, and the Mayor thought he would have the letter to accept it.

Bagnato asked if the Mayor would like to discuss his reasons for this action and the Mayor said he doesn't have to but thinks the most recent concern was from a concerned citizen about the way he as treated. He said he spoke in generalality at the last meeting or one other meeting the way people were treated. There was a resident wondering about a child with asthma and what the Village's responsibility would have been.. Bagnato asked if the Administrator was following policy and the Mayor said he was, but there is also common sense that is to be used. In the packets the Village was owed $6000.00 in back payments and wondered why these people haven't been shut off. Fox's stated concern was he was not at the meetings to answer questions. Dick Maloney stated Brown was rough to him in Council, but fine in his office, with his questions being answered.

Bagnato addressed Council about the issue stating he felt the village was getting a bargain with Brown at part-time with no benefits. The Mayor said he would assume the load. Bagnato thought it would be a better idea to keep Brown on for the transitional period, to get a new Administrator up to speed. He also said Brown's professionalism was spoken well of by residents such as Alex MacNichol, Dan Frederick and Dave Mesenburg. He added to hire someone new would be about $50,000.00 and benefits. Bagnato said it will cause a lot of turmoil if Brown is let go and he was opposed to it. The Mayor was concerned about hacking and destroying what is on the computers. Bagnato said as a retired Naval Officer Brown has a lot of integrity, but the Mayor felt he had a lot of capabilities with the computers.

The Mayor said Brown had a problem with people skills. .The Mayor felt he was left out of the loop with Brown, and Brown not wearing a tie while representing the Village out of town, instead of wearing a t-shirt.

The Mayor made the recommendation to dismiss the Administrator immediately. Motion by Fox to affirm the Mayor's recommendation, seconded by Kovesdi. Roll call: Dickman-yes, Fox-yes, Jenkins-yes, Kovesdi-yes, Wolf-no, Bagnato-no. Motion carried to dismiss the Village Administrator immediately.

Motion by Dickman, seconded by Jenkins to allow the Milan Township Fire Department permission to close N. Center Street between East Front and East Church Streets on Sunday September 4ht, from 7:00 A.M. -6:00 P.M.. Vote-all yeas, motion carried.

Parks and Trees-The Village will hold off on purchasing the sound system until donations come in and the system is researched further.

Taylor Hart will plant a spruce tree on behalf of Tom O'Connor's estate. The Tree Commission will report back with a place to plant that, that will take place in the fall.
