Council Minutes - September 19, 2006

The meeting of  September 19th, 2006 was called to order with the Pledge of Allegiance by Mayor Robert C. Bickley.

Roll call:-present-Bagnato, Dickman, Fox, Jenkins, Maloney and Martin.

Motion by Fox, seconded by Dickman to approve the Minutes of September 5th after amending the vote on the sewer tap  to  read motion by Bagnato, seconded by Dickman to waive the sewer tap fee.  Vote-all yeas,  motion carried.

Motion by Fox, seconded by Jenkins to approve the Council Bills for September 19th, 2006 in the amount of  $16,002.96.  Vote-all yeas, motion carried.

Motion by Dickman, seconded by Fox to approve the Utility Bills for September 19th, 2006 in the amount of $87,425.72.  Vote-all yeas, motion carried.

CITIZEN PARTICIPATION

Marilyn and Diane Ortman and Richard Barkhimer were in attendance.  Marilyn Ortman would like to have input on  2 wheel electric scooters before an ordinance is put in order.

Councilman Michael Bagnato read his letter of resignation effective September 30, 2006.  He has been a part of Milan government as Administrator, Council and Mayor from 1993-2006.  He stated he was proud to have been part of the successful construction of the Administration Building.  Bagnato said he will most miss the employees.  Motion with regrets by Fox, seconded by Dickman to except Bagnato’s resignation.  Fox stated he was sorry to see Bagnato go and always felt Mike had the Village’s best interests at heart.  Vote-all yeas, motion carried.

NEW COMMITTEE BUSINESS

Streets, Sidewalks, and Storm Sewers –The parking lot project is two weeks behind, but all is going well.

Safety-Motion by Dickman, seconded by Jenkins to hold Trick or Treat on Tuesday,  October 31, 2000 from 5:00-6:00 P.M..  Vote-all yeas, motion carried.

Finance-Motion by Maloney, seconded by Bagnato to award the Administrator his 3% raise on his anniversary date of  September 20, 2006.  Vote-all yeas, motion carried.

Regional Planning, Building Codes & Inspection-The Erie County Regional Planning meeting was cancelled this month due to lack of projects.

Utilities-The natural gas cost for 2007 will be a fixed price of 1.224.

Civic Contact and Historical Preservation-Codified-Motion by Fox, seconded by Jenkins to have Edison Drive in front of Sayles house blocked for horse drawn carriage rides, along with permission for event yard signs in the square and neighbors yards for the Settlers Day on October 22.  The signs will not be put up more than one week in advance.  Vote-all yeas, motion carried.

Richard Rench wrote a letter thanking Village employees Pat Fox and Nancy Justice for their time on July 22, when he used Council Chambers.

Parks and Trees-The Tree Commission will meet on September 27, at 2:00 P.M. in Council Chambers.

The electric department will be able to trim trees before fall.

The street department was commended for the job they did picking up brush.

LEGISLATION

A RESOLUTION ACCEPTING THE AMOUNTS AND RATES AS DETERMINED BY THE BUDGET COMMISSION AND AUTHORIZING THE NECESSARY TAX LEVIES AND CERTIFYING THEM TO THE COUNTY AUDITOR.  Motion by Bagnato, seconded by Fox to adopt.  Roll call: Dickman-yes, Fox-yes, Jenkins-yes, Maloney-yes, Martin-yes, Bagnato-yes.  Motion carried, Resolution no. 533-09-06

AN ORDINANCE ESTABLISHING A JURY DUTY/COURT LEAVE POLICY FOR EMPLOYEES OF THE VILLAGE OF MILAN.  Motion by Bagnato, seconded by Jenkins to suspend the rules.  Roll call: Jenkins-yes, Maloney-yes, Martin-yes, Bagnato-yes, Dickman-yes, Fox-yes.  Motion by Bagnato, seconded by Dickman to adopt by title only as an emergency.  Roll call: Maloney-yes, Martin-yes, Bagnato-yes, Dickman-yes, Fox-yes, Jenkins-yes.  Motion carried, Ordinance no. 421-09-06

AN ORDINANCE REPEALING ORDINANCE NO. 320-11-03 ENTITLED AN ORDINANCE REGULATING PARKING ON SOUTH MAIN STREET, AND DECLARING AN EMERGENCY.  Motion by Bagnato, seconded by Fox to suspend the rules.  Roll call: Martin-yes, Bagnato-yes, Dickman-yes, Fox-yes, Jenkins-yes, Maloney-yes.  Motion by Bagnato, seconded by Dickman to adopt as an emergency by title only.  Roll call: Bagnato-yes, Dickman-yes, Fox-yes, Jenkins-yes, Maloney-yes, Martine-yes.  Motion carried, Ordinance no. 422-0-06

A RESOLUTION AUTHORIZING POLITICAL SUBDIVISION TO PARTICIPATE IN THE STATE OF OHIO COOPERATIVE PURCHASING PROGRAM AND DECLARING AN EMERGENCY.  Motion by Bagnato, seconded by Jenkins to suspend the rules.  Roll call: Dickman-yes, Fox-yes, Jenkins-yes, Maloney-yes, Martin-yes, Bagnato-yes.  Motion by Bagnato, seconded by Fox to adopt as an emergency by title only.  Roll call: Fox-yes, Dickman-yes, Jenkins-yes, Maloney-yes, Martin-yes, Bagnato-yes, Dickman-yes.  Motion carried, Resolution no. 534-0-06

Council has 30 days from September 30th to fill the Council seat vacancy, after that point it falls to the Mayor.
