Council Minutes - October 3rd, 2006

The meeting of  October 3rd, 2006 was called to order with the Pledge of Allegiance by Mayor Robert C. Bickley .

Roll call:-present- Dickman, Fox,  Jenkins,  Maloney and Martin.

Motion by Fox, seconded by Dickman to approve the Minutes of September 19th, vote-all yeas,  motion carried.

Motion by Maloney, seconded by Fox to approve the Council Bills for October 3rd, 2006 in the amount of  $15,358.27.  Vote-all yeas, motion carried.

Motion by Dickman, seconded by Fox to approve the Utility Bills for October 3rd, 2006 in the amount of $32,009.48.  Vote-all yeas, motion carried.

Four letters were read by Council President Fox from Nina Kovesdi,  Lois Wolf,  Timothy Justice and James Brown expressing interest in filling the Council seat.  Motion by Fox, seconded by Dickman to re-appoint Kovesdi.  Maloney questioned why the hurry when Council had 30 days to fill the vacancy, and with 4 people running he felt there should be an interview process.  Martin stated most of Council just found out today that there was more than one person interested in filling the vacancy.  She stated townships revert back to the next highest runner, but wasn’t saying the Village should, it was just a suggestion. There will not be enough members at the next meeting for a quorum so the position needs to be filled tonight.  Vote-Fox-yes, Jenkins-yes, Maloney-no, Martin-no, Dickman-yes, motion carried.  Kovesdi is sworn in by the Mayor.

John Zimmerman, Lawrence Smith and Nick White are in attendance. 

AN ORDINANCE CREATING THE VILLAGE OF MILAN RESIDENTIAL BUILDING DEPARTMENT, ADOPTING THE MOST CURRENT DEITION OF THE RESIDENTIAL CODE OF OHIO AS PROMULAGATED BY THE OHIO BOARD OF BUILDING STANDARDS, AUTHORIZING A REQUEST TO THE OHIO BOARD OF BUILDING STANDARDS TO CERTIFY THE VILLAGE OF MILAN RESIDENTIAL BUILDING DEPARTMENT ON THE CONDITION THAT THE HURON TOWNSHIP BUILDING DEPARTMENT EXERCISE ENFORCEMENT AUTHORITY AND ACCEPT AND APPROVE PLANS AND SPECIFICATIONS, AND MAKE INSPECTIONS, AND AUTHORIZING AND AGREEMENT FOR ENFORCEMENT BETWEEN THE VILLAGE OF MILAN AND HURON TOWNSHIP AND DECLARING AN EMERGENCY.  Motion by Dickman, seconded by Fox to suspend the rules.  Roll call: Jenkins-yes, Maloney-yes, Martin-yes, Kovesdi-yes,  Dickman-yes, Fox-yes, motion carried.  Motion by Fox, seconded by Jenkins to adopt by title only as an emergency.  Roll call: Maloney-yes, Martin-yes, Kovesdi-yes,  Dickman-yes, Fox-yes, Jenkins-yes.  Motion carried, Ordinance no. 423-10-06

OLD COMMITTEE BUSINESS

Streets, Sidewalks and Storm Sewers-The athletic signs by the culvert on St. Rt. 113 will be moved to the street barn while waiting for a stationary device.

A resident suggested monthly yard waste pickup from fall to spring.

There was discussion of a fall brush pick up.  The Administrator will look into Huron’s contract.

NEW COMMITTEE BUSINESS

Streets, Sidewalks, and Storm Sewers –The muni parking lot has had 2 extras to date, adding concrete behind one part, and removing and adding behind another.

Safety-Doggy waste bags were given to each police car to be handed out to anyone seen walking a dog not carrying a bag.  They were donated by Jennifer Martin.

The electric department will look into the timing on the traffic light at the intersection.

Finance-The Council Meeting for October 17th  will be rescheduled for October 18th at 7:00 P.M..

The November 7th meeting will start at 8: P.M. due to elections being held in Council Chambers.

Regional Planning, Building Codes & Inspection-The Village received an updated flood insurance map.

Utilities-Erie County Sheriff’s Department arrested 3 in connection with theft of  copper from the sub station .  The Village won’t be getting any of the copper back and  the matter has been turned over to insurance.   

AMP-Ohio is going to buy 50% of the 2008 gas through the aggregation program , since prices are good. 

Test strips were sent out with the last utility bills to test for leaking toilets.

Trick or Treat was mentioned in a timely manner in the newsletter and it was felt it would have been nice to have Bagnato’s resignation mentioned also.           

Civic Contact and Historical Preservation-Codified-The rededication of the flag will be at 11:00 A.M. on November 11th.

Parks and Trees-The trees on front of Copley’s Insurance weren’t topped correctly and will die eventually.

A drawing was shown for what is being planned  with trees and lamp posts by Groff’s Funeral Home, who will be donating some of the money.

UNFINISHED BUSINESS

Kovesdi will assume Bagnato’s committee’s which are Zoning Board of Appeal’s and Park’s and Trees.

Motion by Fox, seconded by Maloney to allow Dan Phillip of Transformation Network to use the Council Chambers on Friday, October 13, from 9:00 A.M. -12:00 P.M. Insurance is in place.  Vote-all yeas, motion carried.

Beck Supplies owns the mortgage to the Citgo Station and is making an effort to take control it, possibly to sell or lease.  They may not get the liquor license and wouldn’t be able to operate without it.

AN ORDINANCE AUTHORIZING THE SALE OF THE VILLAGE PORTION OF RENEWABLE ENERGY CREDITS FROM JOINT VENTURE FOR YEARS 2006 THROUGH 2009, AND DECLARING AN EMERGENCY.  Motion by Maloney, seconded by Dickman to suspend the rules.  Roll call:  Martin-yes, Kovesdi-yes,  Dickman-yes, Fox-yes, Jenkins-yes, Maloney-yes, motion carried.  Motion by Fox, seconded by Jenkins to adopt by title only as an emergency.  Roll call: Kovesdi-yes, Dickman-yes, Fox-yes, Jenkins-yes, Maloney-yes, Martin-yes.  Motion carried, Ordinance no. 424-10-06

AN ORDINANCE AUTHORIZING THE EXECUTION OF A HYDRO DEVELOPMENTAL COST SHARING AGREEMENT BY THE VILLAGE OF MILAN WITH AMERICAN MUNICIPAL POWER-OHIO, INC. AND REPEALING ORDINANCE NO. 413-03-06.  Motion by Maloney, seconded by Fox to put this ordinance on its first reading by title only.

Motion by Dickman, seconded by Fox to adjourn.  Vote-all yeas, motion carried.
