Council Minutes - October 4th, 2005

Regular Council Meeting

The meeting of October 4th, 2005 was called to order with the Pledge of Allegiance by Mayor Robert C. Bickley.

Roll Call: Present --Bagnato, Dickman, Fox, Jenkins, Kovesdi and Wolf.

Motion by Fox, seconded by Kovesdi to approve the Minutes of September 20th , 2005. Vote-all yeas, motion carried.

Motion by Fox, seconded by Jenkins to approve the October 4th, 2005 Council bills in the amount of $13,913.38. Vote-all yeas, motion carried.

Motion by Dickman, seconded by Fox to approve the October 4th, 2005 Utility bills in the amount of $24,109.39. Vote-all yeas, motion carried.

CITIZEN PARTICIPATION

Terry Bergman addressed Council on the levy for the State Theater on November 8th. Tom Soloma also spoke briefly for the levy.

OLD COMMITTEE BUSINESS

Streets, Sidewalks and Storm Sewers-The Village portion of sidewalk repairs are $850.00.

Safety-None

Finance-Motion by Fox, seconded by Kovesdi to authorize RITA to proceed with letters to the approximate 250 names that are alleged delinquent in income taxes. Vote-all yeas, motion carried.

Regional Planning, Building Codes & Inspection-None

Utilities-The PPC formula is now computerized.

Civic Contact and Historical Preservation -None

Parks and Trees-No location was found yet for Tom O'Connor's memorial tree, but should be planted in November.

NEW COMMITTEE BUSINESS

Streets, Sidewalks, and Storm Sewers -Approximately $4000.00 in work has been authorized by the Administrator for the one-ton street department truck.

Leaf pick up is tentatively planned for November 17th.

Safety-Motion by Dickman, seconded by Fox to hold Trick or Treat on Sunday, October 30th, from 4:30 P. M. to 5:30 P.M. followed by the program at Milan Elementary School. The Fire Department will again assist. Vote-all yeas, motion carried.

Finance-None

Regional Planning, Building Codes & Inspection -None

Utilities-None.

Civic Contact and Historical Preservation-Motion by Bagnato, seconded by Fox that the Village of Milan makes a resolution to support the levy at the State Theater for a period of 5 years. Roll call: Bagnato-yes, Dickman-yes, Fox-yes, Jenkins-yes, Kovesdi-yes, Wolf-yes, motion passed.

The Mayor read a Proclamation honoring 96 old Sally McWane.

Motion by Fox, seconded by Dickman allow signs to be put in the square for Settler's Weekend on October 15-16, 2005, to close E. Front at Edison Drive east to the alley from 9 A. M. -5P.M. for the tractor pull, notifying the neighbors, and closing off part of Edison Drive by the Sayles home, putting barriers in front of it. Vote-all yeas, motion carried.

The Health Department will be giving flu shots at the Care-A-Van. The date in not known.

Parks and Trees-The Tree Commission needs to set up a meeting as well as Parks and Trees.

Tree roots were ground under 35 Main Street and by 7 Lockwood.

The sign at Lockwood has deteriorated, with Administrator looking into replacement options.

UNFINISHED BUSINESS

The Solicitor is looking into verbiage for full-time, part-time employment and how it pertains to insurance.

Legislation

AN ORDINANCE AMENDING SECTION 151.03 OF THE CODIFIED ORDINANCE OF THE VILLAGE OF MILAN, OHIO, PERTAINING TO HOLIDAYS. Motion by Jenkins, seconded by Kovesdi to amend the ordinance, to include a January 1, 2005. Bagnato disagreed with the motion, requesting a July 1, 2005 date. Rolll call: Dickman-yes, Fox-yes, Jenkins-yes, Kovesdi-yes, Wolf-yes, Bagnato-no, motion carried. Motion by Fox, seconded by Kovesdi to bring this ordinance to its third reading by title only as amended. Roll call: Fox-yes, Jenkins-yes, Kovesdi-yes, Wolf-yes, motion carried. Motion by Wolf, seconded by Fox to adopt as amended. Roll call: Jenkins-yes, Kovesdi-yes, Wolf-yes, Bagnato-yes, Dickman-yes, Fox-yes. Motion carried, Ordinance no. 389-10-05.

AN ORDINANCE AMENDING PART ELEVEN PLANNING AND ZONING CODE OF THE CODIFIED ORDINANCES OF THE VILLAGE OF MILAN, OHIO. Motion by Jenkins, seconded by Fox to bring this ordinance to its second reading by title only. Vote-all yeas, motion carried.

A RESOLUTION AUTHORIZING THE VILLAGE ADMINISTRATOR TO PREPARE AND SUBMIT APPLICATIONS FOR FINANCIAL ASSISTANCE FOR THE SWAN/LIBERTY STREET RECONSTRUCTION PROJECT, AND DECLARING AN EMERGENCY. Motion by Bagnato, seconded by Dickman, to suspend the rules. Roll call: Kovesdi-yes, Wolf-yes, Bagnato-yes, Dickman-yes, Fox-yes, Jenkins-yes, motion carried. Motion by Bagnato, seconded by Fox to adopt by title only as an emergency. Roll call: Wolf-yes, Bagnato-yes, Dickman-yes, Fox-yes, Jenkins-yes, Kovesdi-yes. Motion carried, Resolution no 528-10-05.

Motion by Dickman, seconded by Fox adjourn, vote-all yeas, motion carried
