» AN ORDINANCE AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR TO ENTER INTO AN AGREEMENT WITH MARGARETTA TOWNSHIP, OHIO, TO ACT AS CONTRACTING AGENT TO PROVIDE BUILDING DEPARTMENT ENFORCEMENT SERVICES TO MARGARETTA TOWNSHIP, OHIO, AND DECLARING AN EMERGENCY.

WHEREAS, Margaretta Township, Erie County, Ohio has experienced difficulty in obtaining the services of a qualified individual to provide enforcement services for the Township's Ohio Building Officials Association One, Two and Three Family Dwelling Code, and currently has no local enforcement of the Ohio Basic Building Code; and

WHEREAS, Huron Township has a Building Department which is certified by the Ohio Board of Building Standards to enforce the Ohio Basic Building Code containing regulations governing the erection, construction, repair, alteration and maintenance of all buildings or classes specified in Section 3781.06 of the Ohio Revised Code, and also has in its employ inspectors certified to perform structural, electrical and plumbing inspections as required by the Ohio Building Officials Association One, Two and Three Family Dwelling Code; and

WHEREAS, the Village of Milan, Ohio, has contracted with Huron Township, Erie County, Ohio, to provide building department enforcement services for the Village of Milan, Ohio; and

WHEREAS, Council has determined that, in the spirit of mutual aid to political subdivisions, it is necessary to enter into a contract with Margaretta Township to provide the enforcement services of the Huron Township Building Department by and through the Village's contract ; and

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MILAN, ERIE AND HURON COUNTIES, OHIO:

Section 1. That the Village Administrator be, and he hereby is authorized and directed to enter into an agreement with the Board of Trustees of Margaretta Township, Erie County, Ohio, whereby the Huron Township Building Department will provide necessary services to Margaretta Township to enforce the provisions of the Ohio Basic Building Code and the Ohio Building Officials Association One, Two and Three Family Dwelling Code, which agreement shall be substantially in the form of Exhibit A attached hereto and made a part hereof.

Section 2. That it is hereby found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of its committees, if any, which resulted in formal action, were taken in meetings open to the public in full compliance with applicable requirements of law, including Section 121.22 of the Ohio Revised Code.

Section 3. That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public health, safety and welfare and for the further reason that proper authorization of the services provided for herein requires that this Ordinance become effective without delay; wherefore, this Ordinance shall be in full force and effect from and immediately after its adoption.
